U.S. Federal Judge dismisses lawsuit against Instagram by its Terms of Service

In December 2012, a change in the terms and conditions of , I almost left out of the social networking world, because of a confusing clause ceding ownership of the images of the user of the application.

After several campaigns where both users and celebrities addressed mobilize to stop using the platform, the class action lawsuit that was filed in justice was dismissed and the company, and acquired by Facebook at the moment, seems to be off the initial fire.

In a brief statement issued late last week, District Judge William Alsup in San Francisco dismissed the lawsuit proceed against Instagram on the grounds that there were multiple procedural errors in the same, as well as for failing to comply with the requirement of “common injury” that must exist when making a claim of this kind.

The federal court ruling does not prevent the plaintiffs can try a new collective action in State cost, but according to legal experts, this would be a high-risk procedure as companies like Instagram, are protected and guaranteed by law to change its terms and conditions provided they notify their users properly.
